Use

  1. A "service" is defined as using the application to create and manage carpools, and to join them as a passenger.

  2. Use of the service is at your own risk. The service is provided "as is".

  3. You may not modify another site to falsely state that it is associated with Caroster.

  4. Accounts can only be created and used by natural persons.

  5. Accounts created by robots or other automated methods may be deleted without notice.

  6. You are responsible for the security of your account and password.

  7. Octree cannot and will not be liable for any loss or damage arising from your failure to comply with this safety obligation.

  8. You are responsible for all content posted and all activity that occurs under your account.

  9. You may not use the Service for any illegal or unauthorized purpose.

  10. You must not violate the laws of your country.

  11. You may not sell, trade, resell or exploit for any unauthorized commercial purpose any account of the Service used.

  12. Violation of any of these agreements will result in termination of your account. You understand and agree that Octree providing the service is not responsible for any content posted on the service.

  13. You understand that uploading the service and your content involves transmission (in clear text or encrypted, depending on the service) over various networks.

  14. You must not transmit worms, viruses or any other malicious code.

  15. Octree does not warrant that the service will meet your specific requirements, that the service will be uninterrupted or bug-free, or that errors in the service will be corrected.

  16. You understand and agree that Octree shall not be liable for any direct, indirect, incidental or consequential damages, including damages for loss of profits, goodwill, access, data or other intangible losses (even if Octree is advised of the possibility of such damages) resulting therefrom:

    • the use or inability to use the service;

    • unauthorized or altered access to data transmission;

    • statements or actions by a third party concerning the service;

    • cancellation of your account;

    • any other service-related issues.

  17. Octree's failure to exercise or enforce any right or provision of the Terms of Service shall not constitute a waiver of such right or provision. The Terms of Use constitute the entire agreement between you and Octree and govern your use of the Service, superseding any prior agreements between you and Octree (including prior versions of the Terms of Use).

  18. Paid features finance the caroster.io service and the continuity of the caroster open source project, and give access to specific functions of the application. These features have the same conditions of use as the rest of the application.

Service changes

  1. Octree reserves the right, at any time, to modify or discontinue, temporarily or permanently, with or without notice.

  2. Octree will not be liable to you or any third party for any modification, suspension or discontinuance of the service.

Content copyright

  1. You may not post, upload, blog, distribute or disseminate any unlawful, libelous, defamatory, harassing, abusive, fraudulent, infringing, obscene or otherwise objectionable material.

  2. We do not claim any rights to your data: text, images, sound, video, or any other element, that you upload or transmit from your account.

  3. We will not use your content for any purpose other than to provide the service to you.

  4. You must not upload or make available any content that infringes the rights of another person.

  5. We reserve the right to remove any content we deem necessary. Not relevant to the use of the service, in our sole judgment.

  6. We may, if necessary, remove or prevent the distribution of any content on the service that does not comply with these terms.


Editing and sharing data

  1. The files you create with the service can be read, copied, used and redistributed by people you may or may not know.

  2. By making your data public, you acknowledge and agree that any person using this website may consult them without restriction.

  3. But the service can also let you authorize restricted access and collaborative work on your documents for one or more other users.

  4. Octree cannot be held responsible for any problems resulting from the sharing or publication of data between users.

Closing

Octree, in its sole discretion, has the right to suspend or terminate your account and refuse any and all current or future use of the service. Termination of the service will result in the deactivation of access to your account, and the return of all content.

Octree reserves the right to refuse service to anyone for any reason at any time.

Octree also reserves the right to terminate your account if you do not log in to your account for a period exceeding 6 months.

Personal information

In accordance with article 34 of the French Data Protection Act, Octree guarantees the user the right to oppose, access and rectify any personal data concerning him/her.

  1. To use certain Caroster services, you must create an account. Octree asks you for some personal information: a valid e-mail address which is used to protect your account from unauthorized access. The "Last name" and "First name" fields may be required for the software to function properly, but it is not necessary for them to reveal your true identity.

  2. Like other online services, Octree automatically records certain information about your use of the service, such as account activity (e.g., storage space occupied, number of entries, actions taken), data displayed or clicked (e.g., links, user interface elements), and other information that may identify you (e.g., browser type, IP address, date and time of access, referring URL).

  3. This data is used to analyze behavior as part of product improvement, in order to maintain a consistent and reliable user experience, but under no circumstances for advertising targeting purposes.

  4. The telephone number, e-mail address, first and last names, trips and dates of the cars are information made available to people who know the URL of the event, in order to ensure proper management of the event.

  5. The email address is used by the application to notify users of updates affecting their participation in an event.

  6. Email can also be used to communicate about service improvements.

  7. Data is not sold to third parties.
